By entering this promotion you agree to be bound by these Terms and Conditions (Terms) and the Promoter in its sole and absolute discretion may refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.

Prize

  1. By entering the Come To Perth’s Refer a Friend Giveaway (Competition) you will have a chance to win one (1) Day Package Perth Experience (Celebrate in the City offer at COMO The Treasury – Prize valued at A$895).
  2. Prizes are non-transferable, not extendable, cannot be redeemed for cash, and are not valid in conjunction with any other offer.
  3. All unclaimed prizes remain the property of Come To Perth.
  4. Come To Perth accepts no responsibility for any lost, misplaced, or misdirected prizes.
  5. The prize is subject to any terms and conditions of individual service provider contributing to the prize.

Promotion Period

  1. The promotion period commences at 12pm Monday 24th May 2021 and ends at 12pm Tuesday 29th June 2021, AWST (“Promotional Period”).

Entering the Contest

  1. Entry is open to all Perth residents (Eligible Entrant) aged 18 years or over. To enter and be eligible for the draw, you must:
  2. Individuals must have an Instagram account
  3. Post a photo that represents Perth.
  4. Tag a friend – must be an international student who lives in Australia outside Western Australia.
  5. More than one photo post is permitted, but you must tag a friend with a different profile name.
  6. Tag @cometoperth Instagram account.
  7. Add the hashtag #cometoperth.
  8. The tagged friend must register to Come To Perth online expo.
  9. The contest is not open to:
  10. Any person living outside of the Perth area.
  11. An employee of any exhibitor or sponsor of Come To Perth.
  12. The Promoter is responsible for determining whether a person is an Eligible Entrant in its sole and absolute discretion.
  13. Entrants must be individuals only and cannot be acting on behalf of an organisation or group.
  14. Eligible Entrants on notification of winning must provide their own legal name and confirmation of age to verify their entry in the Promotion.

Monitoring and Moderation

  1. The Promoter reserves the right to monitor and moderate all entries.
  2. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an: entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  3. The Promoter reserves the right to remove any entries considered to be of an offensive or defamatory nature.
  4. The Promoter reserves the right, in its sole and absolute discretion, to remove any entries that it considers to go against the spirit of the competition.
  5. IIncomplete or indecipherable entries will be deemed invalid.

Determining the Winner

  1. The winner of the prize will be drawn at WeWork, 152 St Georges Terrace, Perth WA, on 2 July 2021.
  2. A Come To Perth representative will select a winner via a random draw. Come To Perth’s decision is final and cannot be contested.
  3. Unless advertised differently, the prize winner will be notified by PM (private message) through Instagram (or Facebook) and/or contacted by email at the end of the Promotion.
  4. If for any reason the Promoter believes the Eligible Entrant has not complied with these Terms and Conditions of the Promotion requirements, the Promoter may, in its sole and absolute discretion, refuse to award a Prize.
  5. A Come To Perth representative may select additional reserve entries which are chosen at random, in case of an invalid entry or ineligible entrant.
  6. The prize winner must respond to the request for contact details from the Promoter within 2 business days of being contacted in order to claim their prize. Should the prize winner not respond within the time limit, the Promoter is within rights to contact the next eligible winner.
  7. The winner will need to claim their prize by no later than 09 July 2021 by providing a valid identification document (driver’s license, passport, ID card) to verify their identity.
  8. If a winner does not collect their Prize by 01 August 2021; prizes will remain the property of Come To Perth. Come To Perth may elect to repeat this process until the prize is collected.
  9. If for any reason the Promoter believes the Eligible Entrant has not complied with these Terms or the Promotion requirements, the Promoter may, in its sole and absolute discretion, refuse to award a Prize.
  10. The Experience (Prize) must be booked at least 14 days in advance following the terms and conditions of individual service provider contributing to the prize.

General conditions

  1. Entry and other instructions contained within promotional material form part of these terms and conditions.
  2. By participating in the contest, you agree to be bound by these terms and conditions.
  3. Come To Perth is entitled at its sole discretion to reject or disqualify any entry which it determines to be incomplete or ineligible or which in the sole opinion of Come To Perth contains unlawful, defamatory, offensive, or other material which if published or broadcast would place the business interests of Come To Perth at risk or adversely affect the goodwill, name or reputation of Come to Perth or any of its sponsors.
  4. Come To Perth reserves the right to refuse prize redemption to any participant that does not comply with these terms and conditions.
  5. By entering the Giveaway, you agree, to have your name, and any photographs of you taken by Come To Perth or its agents published on Come To Perth’s website or social media channels for promotional, marketing, publicity, research, or profiling purposes. You grant to Come To Perth a perpetual, irrevocable, worldwide, royalty-free license to reproduce, communicate, adapt, modify and publish your name or any photographs of you taken by Come To Perth or its sponsors for the purposes of marketing, promotion, and publicity.
  6. To the fullest extent permitted by law, Come To Perth absolves itself of any and all liability, financial or resultant arising out of, or in connection with the contest.
  7. Eligibility Conditions

Entry is open to Greater Perth residents aged 18 years or over (each an Entrant).
Employees, immediate family members, retailers, suppliers, associated companies and agencies related to the Promoter (or any sponsor) are not eligible to enter the Promotion.

Entry Procedure

To enter into the Promotion, the Entrant must:

  • post a photo that best represents Perth on their Instagram account;
  • tag a friend that is an international student who lives on the East Coast of Australia;
  • tag @cometoperth Instagram account in the caption; and
  • add the hashtag #cometoperth in the caption,

(Submission).

The tagged friend must register for the Come To Perth online expo for the Entrant to be eligible for the Prize.

Criteria
The Promoter will determine which 4 Submissions best represent Perth and repost these Submissions on its @cometoperth Instagram account following the Submission End Date. The winner will be determined based on which Submission has the most comments on the Determination Date.

The Prize will be determined by FYME at WeWork, 152 St Georges Terrace, Perth WA, on 02 July 2021 at 12:00 PM AWST.

Redemption Period
The Winner has 14 days from the Determination Date to accept the Prize by providing a valid identification document (such as driver’s license, passport, ID card) to verify their identity. The Winner has until the end of September 2021 to redeem the Prize. The prize is subject to any terms and conditions of individual service provider contributing to the prize.
 
Expenses
The Prize does not cover extra expenses during the staying, only the “Celebrate in the City” offer by COMO the Treasury.
Terms and Conditions
 
  1. Terms and Conditions: Information on eligibility, mechanisms on how to enter, prizes and the information in the Schedule form part of these Terms and Conditions. Participation in the Promotion (including submitting an entry) is deemed acceptance of these Terms and Conditions.
  2. Submission period: You may post a Submission between the Submission Start Date and Submission End Date.
  3. Eligibility: You must meet the Eligibility Conditions specified in the Schedule.
  4. Verification of entries: The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who has not met or does not meet the Eligibility Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. How to enter: To enter and be eligible, Entrants must, during the Promotional Period, satisfy the Eligibility Conditions and correctly submit an entry in accordance with the Entry Procedure, as particularised in the Schedule. All entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission or submission. All entries are final.
  6. Multiple entries: Entrants must enter the Promotion in their own name. Multiple entries are strictly prohibited and each Entrant may only make one Submission and enter the Promotion once. If further Submissions by the Entrant are made, they will be deemed invalid.
  7. Game of skill: The Promotion is a game of skill. As such, the winner of the Prize (Winner) will be selected based on the Criteria and at the sole discretion of the Promoter.
  8. Expenses: Entrants are responsible for any and all expenses incurred when entering the Promotion and accessing, claiming and/or using the Prize (unless otherwise stated in the Schedule).
  9. Prize: The Prize will be awarded in the name of the winning Entrant, in accordance with these Terms.
  10. Winning Entrant: The winning Entrant will be notified through Instagram within 48 hours of the Determination Date.
  11. Determination of Winner is final: The Promoter will determine the Winner in accordance with the Criteria, on or about the Determination Date. ThePromoter’s determination of the Winner is final and no correspondence will be entered into with any Entrant regarding the The Prize will be awarded in the name of the Winner and cannot be transferred or assigned to anyone else.
  12. Cash Redemption: Subject to clause 20, the Prize is not transferable and not redeemable for cash.
  13. Redemption Period: If the Winner does not claim the Prize within the Redemption Period, the Prize will be deemed to be forfeited by the Entrant and the Promoter may, but is not obliged to, determine another Winner in accordance with clause 11.
  14. Unavailable Prize: If any Prize is unavailable and the Promoter has used all reasonable efforts to arrange the Prize, the Promoter may, in its absolute discretion, substitute the Prize with a prize of equal value and/or specification.
  15. Invalid entries: In the event that a Winner’s entry is deemed or found to be invalid, the Promoter may determine another Winner in accordance with clause 11.
  16. Travel: If the Prize involves travel, the components of the Prize must be taken together when offered or are forfeited. If the Prize involves travel and is awarded to multiple people, the Winner and their companion(s) must travel together and depart from and return to the same departure point. The Winner may not accrue any frequent flyer points from making use of the Prize. Any travel and accommodation (if any) are subject to availability and may be dependent on travel class availability and specific room category availability. Travel and accommodation will be arranged by the Promoter or an agent nominated by the Promoter.
  17. Dangerous activity: Where the Prize involves dangerous activity, the Winner acknowledges the inherent risk in such activity and further acknowledges that use of the Prize may result in injury or death. The Winner participates in the activity at their own risk. In claiming and making use of a Prize which involves dangerous activity, the Winner must (and any companion(s)):
    • attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and/or any supplier of the Prize or any part of the Prize, as determined in their absolute discretion;
    • declare to the Promoter and/or any supplier of the Prize or any part of the Prize, any health-related issues that may affect their safe participation in any part of the Prize and obtain a written clearance from a doctor in this respect;
    • not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any part of the Prize;
    • not be under the influence of any drugs including alcohol;
    • comply with all directions of the Promoter and/or any supplier of the Prize or any part of the Prize and any relevant officials; and
    • wear all safety and other equipment required.
  18. Safety: The Promoter and/or any supplier of the Prize or any part of the Prize may in their absolute discretion:
  • reserve the right to refuse to allow the Winner or their companion(s) (if any) to take part in any or all aspects of the Prize if they reasonably believe the Winner or their companion(s) (if any) represent a safety risk or for any other reason; and
  • may cancel the relevant component of the Prize if the conditions are deemed dangerous.
  1. Attendance at a show: Where any part of the Prize includes attendance at a show or event, if the show or event is cancelled, postponed or abandoned for any reason, the Winner will forfeit all rights to attend the show or event and no cash or alternative tickets will be substituted in lieu.
  2. Cash: Where cash is awarded as a Prize, the Prize will be awarded in the form of a bank cheque, via PayPal transfer (fees may apply and are the responsibility of the Winner) or electronic funds transfer to the Winner’s nominated bank account, at the Promoter’s election.
  3. Non-Excludable Guarantees: Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Consumer Act 2010 (Cth) or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
  4. Consequential Loss: Despite anything to the contrary, to the maximum extent permitted by law, the Promoter will not be liable under these Terms and Conditions or otherwise for any special, indirect or consequential loss or any loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use (including both real and anticipatory) and/ or loss or corruption of data, however arising, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
  5. Liability: Except for any liability that cannot be excluded by law (including the Non-Excludable Guarantees), to the maximum extent permitted by law, the Promoter (including its respective officers, employees and agents) will not be liable to an Entrant for, and the Entrant indemnifies, waives and releases the Promoter in respect of any and all liability (including but not limited to all expenses, costs, damages, claims, and losses) arising in any way out of or in connection with:
  • any act or omission of the Entrant;
  • any breach of these Terms and Conditions by the Entrant;
  • any Force Majeure Event;
  • a matter arising out of clause 25;
  • the Winner or their companion(s) (if any) being unable to use any or all aspects of the Prize as a result of clauses 17 and 18;
  • any personal injury or loss;
  • claiming the Prize;
  • use of the Prize in any way;
  • any theft of any Prize or unauthorised access or third party interference in the Promotion;
  • any entry or Prize claim that is late, lost, altered, damaged, delayed or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or
  • any tax liability incurred by a Winner.
  1. Force Majeure: If performance of the Promotion, provision or use of the Prize (or any part of it), or any obligation under these Terms and Conditions is prevented, restricted, or interfered with by a Force Majeure Event, and if as a result the Promoter is unable to carry out its obligations or to provide the Entrant with the Prize (or any part of it), the Promoter may in its absolute discretion, subject to any written directions made under any applicable legislation, cancel, terminate, modify or suspend the Promotion and/or, if necessary, provide an alternative prize or prizes to the same value as the original Prize. The Promoter will give public notice of such an event and that the Promotion has been cancelled, terminated, modified or suspended. Force Majeure Event means any event or circumstance beyond the Promoter’s reasonable control includes but is not limited to epidemics, pandemics and Government sanctioned restrictions and orders, whether known or unknown at the Start Date of this Promotion. The Promoter will use reasonable efforts under the circumstances to avoid or minimise any Force Majeure Event. An act or omission will be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates
  2. Ineligible entries: The Promoter accepts no responsibility and will not be liable for any late, lost, delayed, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
  3. Legal documentation: To the maximum extent permitted by law, as a condition precedent to accepting the Prize, the Winner must sign any legal documentation as and, in the form, reasonably required by the Promoter and/or Prize suppliers, including but not limited to a legal release and indemnity form.
  4. Online entries: In the event that a dispute arises as to the identity of an online Entrant, the entry will be deemed to have been submitted by the authorised account holder of the email address associated with the relevant Instagram account. The Promoter may ask any Entrant to provide the Promoter with proof that such party is the authorised account holder of the Instagram account associated with the entry.
  5. Personal Information: The Promotor collects personal information from Entrant’s or third parties so that it can conduct the Promotion and for other purposes set out in its Privacy Policy. The Promotor may disclose this personal information to third parties, including its employees, contractors and related entities, third party service providers that provide services to the Promoter (including IT service providers, marketing and advertising providers and website analytics suppliers), if the Promoter is required to disclose personal information by law and as otherwise set out in the Promoter’s privacy policy. Where the Promoter discloses personal information to third parties listed in its privacy policy, these third parties may store, transfer or access personal information outside of Australia. If the Entrant does not provide its personal information to the Promoter, the Entrant may not be able to participate in the Promotion. The Promoter’s Privacy Policy contains further information about: (i) how the Promoter stores and uses personal information; (ii) how individuals can access and seek correction of their personal information; (iii) how an individual can make a privacy-related complaint; and (iv) the Promoter’s complaint handling process. By providing personal information to the Promoter, the Entrant acknowledges that the Promoter will collect, hold, use and disclose the Entrant’s personal information in accordance with the Promoter’s Privacy Policy.
  6. Legal Warning: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of any website associated with the Promotion (Site), or the information on the Site, or to otherwise undermine the legitimate operations of the Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
  7. Linked Sites: The Site or platform for the Promotion may contain links to other websites (Linked Sites). The Promoter does not endorse and is not responsible for the content of any Linked Sites. Any Linked Sites displayed on the platform are for the Entrants’ convenience only and the Entrant agrees to access, use and otherwise deal with Linked Sites at their own risk.
  8. Social Media: Social media membership pages, applications and use of social media generally is subject to the prevailing terms and conditions of use of the social media platform, including Instagram. Unless otherwise indicated in these Terms and Conditions, the Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform including, but not limited to, Instagram, Facebook, Twitter and Pinterest. If an Entrant uses social media to participate in the Promotion, the Entrant understands that they are providing their information to the Promoter and not to any social media platform. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users. By participating in the Promotion, the Entrant releases Instagram, Facebook, Twitter, Pinterest or applicable social media site from all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs associated with the Promotion.
  9. General: Unless the contrary intention appears, a reference in these terms or in any advertisement relating to the Promotion, to Australian dollars, dollars, AUD$ or $ is a reference to the lawful currency of Australia.
  10. Amendments: These Terms and Conditions may be amended or replaced from time to time if required by any regulatory authority.
  11. Jurisdiction: These Terms and Conditions are governed by the laws of Western Australia.
  12. Disputes: A party may not commence court proceedings relating to any dispute arising from these Terms (Dispute) without first meeting with the other party to (in good faith) resolve the Dispute. If the parties cannot resolve the Dispute at that meeting, either party may refer the matter to a mediator. The parties agree to attend the mediation in good faith. The costs of the mediation will be shared equally between the parties. Nothing in this clause will operate to prevent a party from seeking urgent injunctive or equitable relief from a court.
  13. Entire Agreement: These Terms and Conditions represent the entire agreement between the Promoter and any Entrant (including a Winner) and supersede any prior agreement, understanding or arrangement between the Promoter and any Entrant (including a Winner), whether oral or in writing.
  14. Representations: To the maximum extent permitted by law, the Promoter excludes all, warranties, guarantees or representations (whether express or implied) except as expressly provided in these Terms and Conditions.
